Changes in Insurance May Affect Your Personal Injury Claim | VA
Virginia has recently seen several changes in auto insurance law, which could have ramifications for many Virginia drivers who are involved in auto accidents. These changes include the elimination of the liability credit, mandatory auto insurance, and an increase in minimum limits. In 2022, there were 122,434 auto accidents in the state of Virginia; 1,005 fatalities and 59,404 serious injuries resulted from those accidents. Almost 20 percent of these auto accidents involved excessive speed, while 6,910 were alcohol-related.
In today’s economy, it can be difficult to maintain insurance on your vehicle, and, in fact, about 12 percent of Virginia drivers are uninsured. While this is lower than the national average of 14 percent, if one of those uninsured drivers hits you and you do not carry uninsured/underinsured motorist coverage, you could be left with serious injuries, perhaps unable to work and make a living, and unable to pay your normal monthly bills.

New VA Law Allows Bad Faith Claims Against Your Own Insurer
Virginia Code Section 8.01-66.1 went into effect on July 1, 2024, across the state. The law addresses a 2017 Virginia Supreme Court ruling that held there is no bad faith in underinsured/uninsured claims made against one’s own insurance carrier. Many personal injury claims can involve bad faith on the part of an insurer who refused to pay a legitimate claim.
Bad faith occurs when an insurance company denies or delays a legitimate claim without a solid reason. While all insurance companies strive to pay out as little as possible, there are some lines they cannot legally cross without committing an act of bad faith. The state’s previous lack of bad faith laws for underinsured/uninsured motorist coverage gave insurers the right to pay nothing or delay compensation for long periods of time with no repercussions.
While bad faith laws in Virginia have seen some positive developments that took steps to level the playing field for policyholders, uninsured/underinsured coverage was generally exempt. Virginia Governor Vetoes Bill That Would Allow "Dreamers" to Work as Police Officers
This year, Virginia lawmakers considered a bill allowing those under the Deferred Action for Childhood Arrivals Act (DACA) to train for and join law enforcement in the state. Younkin vetoed the bill, stating it could "undermine public safety" and "protect illegal immigrants."
In response to criticism of the veto, Youngkin stated that the Virginia Department of Criminal Justice Services can offer waivers for noncitizens who are permanent residents to serve as law enforcement officers on a case-by-case basis. Since most of the support for the bill came from Democrats, an override of the governor’s veto—which requires a two-thirds vote—is unlikely.
