  • Spouses: A U.S. citizen can sponsor their foreign spouse for an immigrant visa. If the couple has been married for at least two years, the spouse will receive an IR-1 visa, which will allow for permanent residence in the United States. If the couple has been married for less than two years, the spouse will receive a CR-1 visa, which allows for conditional residence in the U.S. A conditional Green Card received through a CR-1 visa will expire after two years. The spouses must apply to remove the conditions on a Green Card prior to its expiration, after which the immigrant spouse will receive a permanent Green Card.
  • Children: A U.S. citizen can sponsor a child for an IR-2 visa if the child is under the age of 21 and is not married.
  • Parents: If a U.S. citizen is over the age of 21, they can sponsor their parents for IR-5 visas.

U.S. immigration law allows for the immediate availability of IR visas. Unlike Family Preference visas, there are no quotas for IR visas or limits on the number of visas issued. This ensures that families can avoid lengthy waiting periods until visas will become available.

Requirements for Sponsors
