These applicants must provide evidence of substantial recognition in their field (such as awards, publications, high salaries, or serving in critical roles in well-known organizations), and they are not required to have job offers. EB-1 visas may also be available for outstanding academic researchers or professors who have been recognized internationally for their contributions, as well as executives or managers in multinational corporations. Labor certifications are not required for employers who sponsor employees for EB-1 visas.
• EB-2 visas: The second-preference category of EB visas is for professionals who have obtained college degrees and have at least five years of work experience in their fields. It will also apply to immigrants who have exceptional abilities in fields related to art, science, or business, meaning that their knowledge and skills are significantly higher than average. EB-2 visas require job offers from U.S. employers, who must meet specific requirements for labor certification. In some cases, a National Interest Waiver (NIW) may allow for a visa to be issued without a labor certification if a person can demonstrate that their work would benefit the United States.
• EB-3 visas: This broad category has third preference, and it includes professionals who have bachelor's degrees, skilled workers who have two years or more of experience, and employees who will perform unskilled labor that does not require more than two years of experience. These visas require permanent, full-time job offers and labor certification.
• EB-4 visas: The fourth-preference category includes certain types of people who may be classified as "special immigrants." These include people who work for religious organizations, people who have worked for the U.S. government in other countries, international organization employees or officers who have retired, special immigrant juveniles, and people who have served in the U.S. armed forces.
• EB-5 visas: This category provides immigration opportunities for investors who are planning to make substantial capital investments in U.S. businesses. The investment must lead to the creation or preservation of 10 or more full-time jobs for workers located in the United States. Other requirements will also need to be met, including the investment of a certain amount of capital in different U.S. markets.
